Workers' Compensation & Employers' Liability

If you have employees in New York — even one — you need Workers' Comp. No exceptions. If you get caught without it, you're looking at criminal penalties under WCL § 52, stop-work orders, and personal liability for corporate officers. For standard contractor classes (electrician, plumber, carpenter, painter, etc.) we can typically get you market indications within 3–5 business days. High-risk trades like structural steel, demolition, or excavation may take 2–3 weeks as these often require surplus lines underwriting. The more complete your submission (ACORD apps, loss runs, contracts), the faster we can move.
The basics: your trade classification, number of employees, annual revenue/payroll, and 3–5 years of loss runs from your current carrier. If you have contracts that require specific coverage, send those too — we'll make sure your policy meets the requirements. Don't have ACORD applications? No problem — we'll prepare them for you.
Yes — this is one of our specialties. Standard carriers often decline demolition, structural steel/iron work, excavation, pile driving, and facade restoration because of the NY Labor Law §240 exposure. We access surplus lines markets through ELANY-authorized filings and place these classes with specialist carriers. It costs more than standard trades, but we'll get you covered.

This includes ACORD 25 certificates with Additional Insured, Primary & Non-Contributory, and Waiver of Subrogation endorsement evidence. If your request requires a carrier-issued named endorsement (not blanket), that may take 3–5 business days depending on the carrier.
In New York, sole proprietors and single-member LLCs with no employees can opt out of Workers' Comp coverage for themselves. However, many GCs and property owners require a Workers' Comp certificate regardless — even from solo operators. If you can't get a WC policy, you'll need a NY Workers' Compensation Board exemption certificate (CE-200 or equivalent). We can advise you on which route makes sense for your situation and help you get the right documentation.
